08-11-21 user Elis5713 purchased a new Bronze M3 Compact .22 cal serial #2139203 (now considered stolen and blacklisted serial number)

08-12-15 rifle shipped to Elis5713 via FedEx with direct signature required so it would arrive when he would be home at the address on Sunday 08-15-21 for delivery as discussed.

08-15-21 FedEx proof of delivery shows signed and delivered by "Elis" at approximately 9:30AM.

08-15-21 (same day 11hrs later) at approximately 8:30PM user Elis5713 lists his old FX Impact MK2 that he was replacing with the new Impact M3, per our phone conversations, for sale on this forum. (click here)

08-18-21 Elis5173 calls asking us to make a claim for him to FedEx, that he spoke to the driver directly, who said he signed in Elis' name and left the package in the hallway which was then stolen. 

09-01-21 FedEx denied his claim since there was no proof of mishandling the package or that the driver signed in his name and left the package in a random hallway.

Elis5713 refused to file police report even though we informed him it was a requirement per our policy for us to help him further after the FedEx claim denial. 

Elis5713 then used the credit card company to try to get around our policy which was decided in our favor due to this compelling evidence that we did everything we could to provide services as agreed.

11-22-21 we received a second chargeback for the same transaction.

The when check the status of the delivery it showed delivered and "signed" by eelis. Yes that is how the driver spelled it . You would think I know how to spell my own name. Anyone with the tracking info can look that up. My impact mk2 was listed for sale . That has nothing to do with my transaction with you. I have to may pcps (most are FX) here's a list for you of what I had at that point. Fx impact mk2 (2), one purchased from Ua and the other from this forum. Wildcat mk3, daystate Delta wolf, daystate MK4, daystate Airwolf, bsa R10, Cz200. So as you can see I have more pcps then I need. I sold my mk2 impact to orion on this forum.

Let's talk about this fedex claim.

YOU insured a $2000 rifle for $500 (confirmed by fedex). During our conversation YOU never once mentioned insurance to me at all. If you tell me hey this gun is only insured for $500 I would tell you to up the insurance to the full cost of the gun even if it's extra cost to me. When you filled the claim on the lost gun YOU filed the claim for $2000. I'm no insurance agent but if you pay for insurance coverage for $500 what in the world makes you think they will cover $2000. 

Now the police report. I called the police in my town. In their exact words " no police report is required since we can not investigate ". I then called fedex to verify if a police report is required. Again I was told no it was NOT REQUIRED. so the police and fedex tell me it's not required so I did not do it. 

You left out the part when I called you to reopen the case through fedex. You also left the part where you did NOT WANT to deal with the case any more. Therefore it's in my hands.

Do you remember when I called you and told you I have all the contact information for the local fedex warehouse the delivery was from? Did you forget the part that the manager called the driver while I was on the phone and the driver admitted to forging my signature? You leave out the important details to make me look like the bad guy in this .

Of course I would go to the credit card company to fix this issue. Why? Simple you refused to do any work towards getting this resolved. You claim that you could not get a hold of fedex or the driver or anything during our calls. Why did it take one call for me and I was able to get all the information I needed. The answer is simple I was willing to do the leg work to make sure I don't get screwed. I think your view of this world is completely messed up. Packages get lost in the mail all the time. Does that make the person that bought the package responsible, or you to make sure everyone is covered? Yes the credit card company charged back the money because I did not receive my package. Would you be willing to pay $2000 for something and not get anything in return? I don't know about you but I'm not made of money and $2000 is alot to loose. When we talked over the phone you kept saying that even if fedex paid out the claim I would still be short $1500 since you only insured it for $500.


 
I called you multiple times to get this resolved and all you did was accuse me of something I did not do and here you are again. How anyone can do business with such a dishonest dealer is beyond me. I have purchased multiple guns from multiple dealers and never had a single issue. For instance the delta wolf was over $3000. That gun came from aoa. I bet you can call them and they will tell you straight away that any shipping issues will be covered because they insure it properly. Don't try to pin this on me when you made multiple mistake and just blame the customer. I was able to call fedex and get a copy of the signature and everything. What stopped you from making a few calls and getting the right information. Instead you post on here to dirty my name. Let's not forget your emails threatening emails about how you will send me to collections.

We did all the leg work for you. You refused to complete the police report which was the road block to help you any further.
 
I understand you feel some type of way about getting the charge back but again would you just give someone $2000 for nothing? If you wanted to resolved this in a civil manner you could called me. You have my number feel free to call me . I have nothing to hide but you left our plenty of details. I'm sure there are plenty of members here that have purchased something and their package got lost or stolen. Does that make them responsible for it especially when the vendor or retailer did not insure it or even explain the insurance policy to the customer. I have nothing against you but put out the facts not what is convenient to you. I'm sure you think it's ok for someone to just hand you $2000 for nothing. I work hard for my money as many members on this site know on a personal level. Even the utahairguns guys have made mistakes on my orders. But those orders quickly got resolved with no issues for anyone whatsoever. For example I purchased a barrel kit from them but received the wrong length. You know that they did when I called them about it. Send out the correct part and I sent them the incorrect part. I'm not trying to get anyone else involved in this issue but your business practices are terrible. How your still in business is beyond my understanding. Even a better question is how fx allows you to do business with them. When you sell something to someone especially online make sure both you and the buyer is covered. Don't cheap out to save a few dollars and only cover it for $500 when you know it cost $2000. For God's sake do you not know value of what your selling. I'm not sure what in the world your tying to prove but I'm not responsible for your mistakes.

The claim was for $1999.99 and it was denied.

You are absolutely right. We have refunded and replaced many orders. Unfortunately when an order of this value which shows it was signed for by the receiver we ask a very easy task to send a copy of a police report. When that is the only thing in the way to move foward would you refuse to get it?

Normally the driver wouldn’t be responsible but it this situation, not only is he liable, it’s a criminal action. A Fed Ex scanner takes GPS coordinates and a picture upon delivery. It shouldn’t be that hard to find. Or… get a refund. The purchaser shouldn’t be on the hook for $2000 because the seller didn’t insure it. Call the Fed Ex office where the signature was forged and get to the bottom of it!

Hmm, from what I understand Elis5713 has purchased from you before and had no issues whatsoever. For what reason would he decide to pay for a product, have fedex state they dropped it off with his signature, then tell you he did not receive the product? Maybe Elis never got it? Elis' number one product is fx, he is a honest person and has no reason to steal something he can afford to buy. I do not agree that elis would willingly steal anything from you. This is not right that you are trying to slander his name in front of people who know better. 

FedEx as well as all of the other delivery services is very well known to drop off packages and state they had a signature. I have had many items dropped off with signature required yet somehow I got the package without ever seeing the FedEx driver. How is that? I even have video of delivery driver just placing my $3000 Air gun box up against the hand rail by the steps without signature that was clearly required!

I have made purchases from Elis in the past with no issues at all. I also made a large purchase in the amount of 3000 for a preowned airgun that was paid thru zelle. I do not have any issues buying from Elis in any way. And guess what? I have never met Elis but I would trust his word if he said he never received something that I sent him. I have sent many things to Elis with no issues. He even insisted in the past to pay for things that I have given him for just the cost of postage.

I think your post should be retracted and you deal with elis or his lawyers directly. From what I have read so far I feel I have no need to ever make a purchase from Palm Beach Air Guns

Whether the insurance covers any amount we were willing to help him out regardless if he provided the police report which for some reason he called them and spoke to them but still didn’t get a copy of the report. It was the only thing we were asking for and it was very clear that once we had that we could move forward.

Doesn't matter if they shipped it to the wrong spot or someone grabbed it and stole it. Point is I did not receive my gun. why would I just let you keep $2000 of my hard earned money? When you purchase something from your vendors or wherever you get your parts and guns from, are you responsible for what happens in transit or are you responsible once you hace custody of it? Look at the tracking and then look at the signature. Let me know who eelis is. I can tell you it's not me. A lot of times the police will say a report isn’t necessary. I’ve been in the same situation before. I understand you’re both pissed at each other and it will be hard but try and get together and solve the problem. If the driver signed Elis’ signature, they are liable, period! I’ve dealt with Eli’s before, many times. He is trustworthy. Good luck guys.

So your telling Me that if fedex approved the claim then what? You would receive $500 right? You would refund me thr $500? What about the remaining $1500. Am I just going to loose $1500 because of your mistake ? Seems a bit messed up don't you think. How is it ok for me to take a $1500 or even a $2000 loss because you did not want to insure the gun properly? If you would have spoken to me about the insurance I would have asked for full Coverage like any other perso with common sense. The extra $50 or whatever it would have cost is nothing compared to $2000.

Again you did not want to refund me the money hence why I had to go through my credit card company. Didn't you just say the police report was for FedEx? What does your policy have to do with fedex approving or denying a claim. You seriously don't think that the fact that you filed the claim for $2000 had nothing to do with the denial? If anyone here deals with insurance please shed some light on this. I would think that once they see that it's just a huge red flag. You still have not answered my question on what would happen with the rest of the money even if they approved the $500 amount? Remember your exact words to me when I spoke to you about this was " you would be responsible for it"
