Legality and / or responsibility?

Have a member who wishes to purchase an air rifle form me who resides in New Jersey. The airgun in question would violate legality in New Jersey. The member has expressed the desire to meet me in NY and buy from me direct so I would not have to ship it there. does this render me free of legal issues? The member is fairly new but seems to be building a good reputation. This is actually a rhetorical question, I've sort of already decided, but want forum input. Even if this person had a FAC or jersey's equivalent. They would still be breaking the law the moment they drove back over the bridge.
 
Sounds similar to us selling between England and Scotland - now that Scotland have that daft AWC (air weapons (hate that word) certificate) for all sub 12 air rifles and pistols)

My take on it is that I live in England so, as I'm not subject to Scottish laws, I'll sell kit to whoever I chose (within reason). After that, it's the Scottish buyers responsibility.
 
Everyone has to determine their own personal standards. Mine – I will not knowingly be party to an illegal activity, period. Others here certainly will have a different set of values.

Liability? Depends upon whether or not there are ramifications from buyer’s misuse of airgun and whether how it was obtained is relevant. Who knows.
 
He lives in NJ , I live in Illinois. EVERYTHING is illegal in Democrat states. I ignore them.

To the OP, I had a similar proposition from someone who Lived in Jersey. I did my research, and while we can’t ship to them, I’d they were to pick it up in NY, or any state where it’s legal, it then becomes their problem.
 
If something happens and you're now being questioned about the transaction are you going to tell the truth or will you be willing to lie.
It may be a small thing to sell an air gun but how do you feel about moral character? Are you a take and try not to be taken sort of person or are you willing to stand up when the call comes, and be counted on the side of truth and honor?
There are injustices all around. Is this a stand your ground, defend your rights and liberties moment?
Yes, the buyer is ultimately responsible, but now knowing their intentions, you may be also. Can you live with that?
Our founding Fathers were all considered criminals for what they were doing but for a right reason.
This is all somewhat dramatic given what you may or may not be doing but at the heart of every decision is the heart of that person. There is no gray area only right and wrong and yes, sometimes, doing what's right can be in violation of a law.

I always decide whether to sell an airgun to someone from another state based on what the big airgun stores policy is for that state. If they won't ship to them neither will I. I also wouldn't work around it by a F To F in a legal state that they don't live in. All that does is give the anti gunners more ammo to ban things like gun shows and F To F sales. Happened with PBs when guys went to other states gun shows to buy PB guns F To F when they were illegal in their states. Same thing could happen to us if we don't follow the rules. Just saying.
 
NJ will treat it as a straw purchase most likely. You knowingly sold a restricted item to someone who resides in that state and is trying to circumvent their authoritarian laws. Run away, not worth the head ache.

If walmart, PA, AGD, ebay won't let you sell to those states, I'd think I'd follow suit.
 
I think you were fine until you posted on a public forum. You have publicly stated that a sale you are making is not legal to this person. You are equally liable for any actions that may arise from his purchase. Perhaps not from a criminal suit but definitely from a civil suit.
