Moderator, suppressor rules.

I looked for a sticky but did not find. I am used to paying the gov’t a fee and filling out paperwork to own firearms suppressors for powder burners. I am seeing in the airgun community that this is not so? You guys just buy and install?

What is the difference? What would happen to me if i have papered suppressors, and also airgun suppressors in my possession. The Alphabet org could claim i had them to install on my powder rifles? I need educated before i own one of these. Is there a resource here?

Use the term powder burner also…

Store the airgun moderators separate from the pb suppressors.

The threads are not the same and they can’t withstand the pressure or heat of a pb.
Storing suppressors in a different place does not hold any water with Alphabet org. If they are in your house they are “in your possession”. Threads do not matter either as i can get any threads i want on powder burn suppressors.

Is anything stamped on airgun suppressors identifying them as not “real”?

Not real ? Shoot an airgun with and without one, tell me it’s “not real”.

I have PB and airgun moderators. Fairly certain if I was able to screw one onto my 22LR it would bulge it like a whiskey barrel.
And that's a good thing BUT again the ruling in the case cited makes it clear that INTENDED USE is the determining criteria. The implications of that are extremely significant. I suppose just how important would require an appeal to the US Supreme Court and as noted... The Agency did not appeal the case.

They have no lack of money and they have no lack of time. That leads me to believe they may have had a lack of confidence they could win the appeal.

Intent is a pretty significant (and fundamental) legal concept... So...

I'm thinking their concern was about the impact of a failed appeal upon the whole structure and viability of the NFA and the Agency's various (and "creative") interpretations of the Act.

That said. It is an opinion NOT legal advice.

It's not like your airgun is that loud anyway.
Depends on the airgun.

My neighbors would not tolerate my early morning practice sessions with my 70 foot pound Condor nearly as well if I was not running a good moderator.

The only reason the bare rifle is not as loud as a rim fire is because I tune it to run subsonic.

I once had a direct face to face conversation (Circa 2003) with the then Agent in charge (Dallas Office) of said alphabet corporation. About having a airgun interment in my house with firearms present.
He stated that if he "Served a warrant on my house and there were no firearms that the interment would fit (Attach) than there is no issue". This agent is more than likely retired and I no longer live in Texas. Your mileage my very.

Yes, just buy an airgun moderator and install it on your airgun. Because it is legal to do so. Every aftermarket mod is inscribed with "Airgun Use Only" or similar. The alphabet org you mentioned does not have any jurisdiction over airguns or airgun parts.

The only way it will become an issue is if people keep raising their hand trying to make a stink about it...hint hint.

I fully agree. The burden of proof also lies with the accuser. Simply having the items capable of suppressing sound is not enough. Everyone has a pillow or a soda bottle and tape at home this does not suggest intent. I make sure none of my powder burners and airguns are threaded the same and also store them separately. It may not matter to the arresting agency but may be useful to a jury to know that I am law abiding in all aspects of my life and took steps to ensure no lines are blurred. I am cautious and careful, but not paralyzed by fear that any agency is out to get me.

Snip” The burden of proof also lies with the accuser. ‘’ Snip
It should work that way, but it doesn’t in real life. The makes up their rules as they go along, even though they are NOT the section of the gov’t elected to make the laws.

That is the first I have heard that they will be inscribed with airgun use only or similar, but that is the type info that I am investigating. Thank you. That would definitely help. I am not making a stink about it. I am looking for info to cover my ass as I own Suppressors already. Being quiet about it until it goes bad is not the solution I am looking for.
