Rattle snake hunting, New LAW

I hunt on a KLR 650 on the back roads around Odessa , I like to hunt with a P17 with a holster on my side , Shoot the rattler in the head and save the skin,A year ago I was told by a Deputy Sheriff that I could not do that as the P17 looked like a real gun, Now with the new open carry laws there should be no problem with my P17 on my side, I will just make sure I do not get in a gun fight, LOL. My 9mm is in my tank bag... OH Big OH You can not discharge a gun from a vehicle or from the side of any public road,,, THE P17 is not a firearm and does not fall under that law......

I wouldn't do any of it just because it's an airgun but to each their own.

By doing things with AG's that firearms aren't allowed to seems to asking for the AG to get regulated.

I used to get road kill rattles and give them to a friend , she would make head bands from them.

You missed the point trying to cherry pick. Hunting in Texas is not allowed on any right of way, or from any vehicle unless on private property, with anything. Permitless carry or not.

This place has a lot of cards and irresponsible "hunters" and "shooters".

Perhaps you noticed airgunmike56 said he lives in Odessa? In Odessa/Midland rattlesnake roundups are a common thing in the summer.
Why are rattlesnake roundups a common thing, you might ask?
Because there are more rattlesnakes in the Odessa/Midland area than you can shake a snake...er ah ...stick at.
Thinning out the population is a necessary thing.

Using an air pistol on a poisonous reptile in Texas is not 'hunting', per se. It is more correctly defined as self defense, of which Texas being a 'Stand Your Ground' state, is encouraged. 

Also in Texas, the dispatch of nuisance animals (which does include poisonous snakes) is allowed by law.

In Texas, native snakes are not listed as nongame animals. The only 2 that are protected are the eastern timber rattlesnake and the indigo snake.
However, they also aren’t specified as a game animal. There is no defined bag limit for snakes in Texas. Here’s some further information on venomous snakes in Texas.

rattlesnakes are so timid and slow moving you can take them out with anything .. i used to strap a co2 .177 on the back of my dirtbike seat just for snakes ... i'd like to see a cop try to make an issue out of an 'obvious' bb gun myself lol ... but yeah i wouldnt want a replica realistic firearm looking one ...

+1 on CO2 bb pistols for snakes. I use a Daisy 415 as a backup pistol for snakes when I'm fishing. Recently, mine did in a cottonmouth.

After September 1st of this year, non felons in Texas can openly carry a genuine pistol and/or anyone can openly carry a 'replica realistic firearm looking one'. 

It'll be interesting to see how many folks start carrying hoglegs tied to their legs. *Smiles*

Tell all that garbage to a game warden. OP is fortunate a deputy was telling him to put a halt. A game warden would have likely made for a very different story.

Permitless carry, permit CC, or open carry have nothing to do with the original post, other than a misguided deputy who said the air looked too real.

Please show us the specific statute where wearing a P-17 on ones hip while engaged in dispatching deadly nuisance animals constitutes a violation of any of the said statutes. 

Since you're speculating on what a game warden likely would have done in the same circumstances as the misguided deputy; I too am allowed to speculate, am I not? I speculate it is likely that a game warden would have joined him in the necessary task the OP was taking care of. My further speculation is that the said game warden would have been extremely impressed w/ the inherent accuracy of the P-17. Would you like to know why I am making this particular speculation?

I was accosted recently by a game warden.just after shooting a water snake in the head w/ my own P-17 at a local pond while fishing there. He had witnessed me shooting the water snake. Discharging a pellet gun inside the city limits where I live is ordinarily a Class C misdemeanor, I might add. Want to know what the game warden did? He asked to see my fishing license and the license of my friend. 

His words to me were and I quote: "Did you get him? I need to see your fishing licenses, then I'll be out of your way". He didn't care about the snake.

He liked my P-17, btw. He was especially impressed by the Feyachi 2 MOA red dot sight I have on it. He really liked the relatively inexpensive cost of the P-17 and red dot sight. Who knows? Maybe I made an airgunner out of him.
