Basically if you throw a leg over the seat and it has two wheels and a motor larger than 90cc then it's a motorcycle. If you step into it and sit on it like you are sitting on a chair then it's a scooter.

A Moped generally has a scooter frame but is under 50cc. In my state anyone with a valid DL can ride a moped. Once you go above a 50cc engine then you need a motorcycle endorsement. Ebikes are also classified by motor size and highest speed. Basically a class 2 Ebike is considered a bicycle but once it goes over 25-30mph it becomes a class 3 and has to be licensed as a moped and has to follow the same driving rules as a car.
